Sep 1 at 15:11 comment added phoog @florian free movement rights would allow the foreign spouse to move to Germany without having to fulfill any language requirements, etc., because the applicable rules would be those provided by directive 2004/38/EC rather than those established under German national law.
Jul 31, 2023 at 9:28 comment added gnasher729 I believe EU "free movement" laws don't apply automatically to citizens of the country itself, like Germans moving to Germany, but local law applies. And in the case of Germany, I think free movement of Germans with foreign partners to Germany is not covered by free movement rights. Anywhere else in the EU, yes.
