Anyone who drives on a foreign license after living for more than 90 days in New York should expect that if they are stopped by a police officer in New York they will receive a summons for driving without a valid license and that they will have to challenge the charge in court. Whether an H-1B worker would be successful in that challenge probably depends on individual circumstances.
